By accessing or using the Mia’s Tree Lot website, you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use immediately.

Please read carefully before allowing children to handle or interact with these products.

1. Product Safety, Use, and Liability

Your purchase and use of our products are at your own risk. We provide items on an “as is” basis, and we offer no other warranty, express or implied, regarding reliability, durability, or performance.

A. Product Warnings and Usage

General Care: Colors may fade over time. Do not turn products upside down, submerge them in water, or use them outdoors, as weather will damage the product (no refund will be issued for outdoor use) or swallow any small parts. Do not put in eyes.
Electrical Safety: Do not keep our products plugged in for too long; this can result in a fire. Keep away from heat, sparks and open flame. Use only as directed/intended. Lights must be used strictly according to manufacturer instructions. Inspect Before Use: Always inspect lights for damaged cords, cracked sockets, or loose connections before plugging in. Do not use damaged sets.
No Overloading: Do not connect more light sets than recommended by the manufacturer.
Adult Control: Placement and operation of all plug-in lighting must be handled exclusively by adults. Do not leave unattended near flammable materials
Physical Safety: Do not swallow or put parts in eyes. Keep products out of the reach of children. Keep away from heat, sparks, and open flame.
Ingestion & Small Parts Hazard
Magical Reindeer Food: This product is designed for decorative use outdoors only. It is NOT FOOD and is NOT FOR HUMAN OR PET CONSUMPTION. Ingestion is not recommended.
Stocking Stuffers/Crayons: These items may contain small components (such as small crayons, candy, or toys). CHOKING HAZARD – Not intended for children under 3 years of age. Adult supervision is required.
Crayons are NOT FOOD. Do not eat or chew. If ingested, contact a Poison Control Center immediately 800-222-1222
Christmas Bubbles
Avoid Contact with Eyes: If solution gets into the eyes, flush immediately with copious amounts of clean water for several minutes.
If irritation persists, seek medical attention.
Bubble solution is NOT EDIBLE. Do not drink, swallow, or ingest.
If accidentally swallowed, drink water or milk immediately and consult a doctor if discomfort occurs or call the poison control center 800-222-1222.
For best results, use outdoors.
Eye & Skin Irritation
WARNING: Photosensitivity: People who are photosensitive (have had seizures induced by flashing lights and patterns) should not use our products without first consulting a doctor. Photosensitivity may occur in children who have no history of prior seizures or epilepsy.
Products/ Specialty Items/other items sold at craft shows/or mechanical items used on our products (e.g., Crayons/batteries): These items are sold "as is." Adult supervision required. Avoid use of small parts/items with children younger than 3 years (choking hazard). Products can contain a button, coin battery, AAA or AA batteries. Ingestion is a serious hazard, as it can cause death and internal chemical burns. Keep new and used batteries out of the reach of children. Seek immediate medical attention if a battery is suspected to be swallowed or inserted into any part of the body. We assume no responsibility for any allergic reaction or loss of life. Use at your own risk.
General Supervision
Continuous ADULT SUPERVISION is mandatory when children are using any of these products.
By purchasing this item, the buyer assumes all responsibility for its safe use.

B. Limitation of Liability

Mia’s Tree Lot shall not be liable for any direct, indirect, punitive, incidental, or consequential damages (to property or life) arising out of or connected with the use or misuse of our products. You assume the entire risk as to their quality and performance. If the product proves defective, you assume the entire cost of all necessary repair or servicing.

2. Pricing, Shipping, and Order Fulfillment

A. Pricing and Taxes

Prices may change at any time without notice, depending on the cost of supplies and events.
Taxes will be charged on all items sold.
Listed prices do not include shipping, handling, or taxes.

B. Returns, Refunds, and Exchanges

Customer satisfaction is very important. Refunds are considered on an individual basis under the following conditions:

Shipping Damage: Refunds are issued only due to severe damage while shipping. You must contact us immediately. A refund will be issued once the merchandise is returned to us and the shipper (usually UPS) has fulfilled their requirements for a damage claim.
Shipping Damage Repair: If minor decorations become loose or fall off during shipping, the buyer is responsible for the repair.
Return Costs: Buyers are responsible for all shipping return costs. This amount will not be refunded.
Item Condition: If the item is not returned in its original condition, the buyer is responsible for any loss in value.
Non-Returnable Items: We do not accept exchanges or cancellations. There are NO RETURNS on custom work/orders, clearance items, or items purchased at craft shows or events. These items are sold "As is."

C. Custom, Bulk, and Event Orders

Payment: Payment is expected before production begins for Custom, Wedding, Quinceañera, or any bulk order. Once production starts, there are no refunds or exchanges.
Fees: A special handling fee and setup charge will be added for bulk orders. An extra charge will apply for drop-off services or if travel is required outside our standard area.

D. Shipping and Pickup

Shipping Address: You are fully responsible for ensuring your shipping address is correct on your order at all times. We are not responsible if items are shipped to an outdated, wrong, or invalid address provided by you.
Customer Pickup (Oswego, IL): All customer pickups must be near Oswego, IL. You are responsible for making arrangements. If we agree to travel further, an additional charge will be added and must be paid, or the order may be canceled after 5 days of no response. If we can not travel you are responsible for your tree pickup.
Item Holds: If we agree to hold a tree for purchase, the hold is for five business days. We reserve the right to sell the tree without notice if we do not hear from you after that period.

3. Intellectual Property, Submissions, and Content

A. Website Content and Copyright

The content of this website is protected by copyright. No portion may be copied or replicated without the written consent of the owner.

B. User Submissions and Ideas

Ideas/Recommendations: Once you submit an idea/recommendation to the Owner, the idea becomes the sole and exclusive property of the Owner without further liability or compensation to you.
Photos/Videos: By submitting photos or videos, you grant Mia’s Tree Lot permission to publicly display, copy, reproduce, and use the content in any media for editorial and promotional purposes without payment or remuneration to you or any third party. You also allow Mia's Tree Lot to edit, crop, or alter the submission as we choose.
You are solely responsible for any information that you submit to us. By using the Site, you agree not to submit or transmit any defamatory, abusive, obscene, threatening or illegal material, or any other material that infringes on the ability of others to enjoy the Site or that infringes on the rights of others. We reserve the right (but assume no obligation) to monitor, delete, move, or edit any submissions that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons.

C. Music and Third-Party Links

Music: Mia's Tree Lot respects all property rights. We use some music with our trees and in our social media videos but do not own any rights to that music or any characters used. Some music is also added to our videos for social media purposes. Not all trees will have sound even if you see one of our videos, please send us a request if you would like sound added to your tree.
