If you do not agree with these Terms, please do not use this website or purchase or use our products.

 

CUSTOMER RESPONSIBILITY

Customers are responsible for reading and following all product labels, directions, safety warnings, ingredient disclosures, manufacturer instructions, and these Terms before using any product.

Products must be used only for their intended purpose and in accordance with all accompanying instructions and warnings.

If a product is purchased for another person, the purchaser is responsible for providing the recipient with all accompanying safety information, warnings, instructions, and product information.

Nothing in these Terms is intended to waive or limit any legal right or responsibility that cannot lawfully be waived or limited.

Mia’s Tree Lot grapevine trees and related decorative products are handcrafted decorative items.

Some products may contain electrical components, plug-in or battery-operated lights, batteries, cords, small decorations, mechanical components, or other accessories that require proper use and adult supervision.

OUR GRAPEVINE TREES AND DECORATIVE PRODUCTS ARE NOT TOYS.

Parents and guardians are responsible for ensuring that children do not use, operate, or handle these products without appropriate adult supervision.

 

1. HANDCRAFTED PRODUCT VARIATIONS

Each Mia’s Tree Lot grapevine tree is handcrafted.

No two handcrafted products will be exactly alike.

Natural grapevine and handmade construction may result in reasonable variations in:

• Shape

• Size

• Color

• Vine placement

• Decorations

• Lighting placement

• Texture

• Accessories

• Overall appearance

Product photographs are intended to represent the overall design and style. They do not guarantee that every handmade product will be identical to the item photographed.

Reasonable handmade variations are not considered defects.

 

2. GENERAL PRODUCT SAFETY

Customers are responsible for safely displaying, operating, maintaining, and storing their products.

Unless a product is specifically identified as suitable for outdoor use:

• Products are intended for indoor decorative use.

• Do not expose products to rain, snow, excessive humidity, or moisture.

• Do not submerge products in water.

• Keep products away from fireplaces, candles, stoves, heaters, sparks, and open flames.

• Do not place products where they could fall or create a tripping hazard.

• Do not swallow, chew, or place decorative pieces or components in the mouth.

• Do not place product components in the eyes.

• Keep small parts away from young children and pets.

• Do not modify the product in a manner that creates a safety hazard.

Inspect products periodically.

Discontinue use if a component becomes damaged or appears unsafe.

 

3. ⚡ ELECTRICAL & LIGHTING SAFETY

Products containing electrical or lighting components must be operated according to the applicable manufacturer’s instructions.

Before operating lights:

• Do not operate damaged electrical components.

• Do not use frayed cords, cracked sockets, exposed wiring, or loose electrical connections.

• Do not overload electrical outlets.

• Do not connect more light sets than the lighting manufacturer permits.

• Keep electrical components away from water and excessive moisture.

• Keep lights and electrical components away from flammable materials.

• Do not modify electrical components.

• Do not use electrical components for purposes for which they were not designed.

DO NOT LEAVE ILLUMINATED PRODUCTS OPERATING UNATTENDED.

Turn off or unplug electrical products before leaving the home or going to sleep unless the applicable manufacturer’s instructions expressly provide otherwise.

Adult operation and supervision are required.

Mia’s Tree Lot is not responsible for damage or injury caused solely by misuse, unauthorized electrical modification, failure to follow manufacturer instructions, use of visibly damaged electrical components, or other use contrary to these safety instructions, except to the extent applicable law provides otherwise.

Some products may contain:

• Button or coin batteries

• AA or AAA batteries

• Battery compartments

• Remotes

• Small decorations

• Small mechanical components

• Other small parts

WARNING — CHOKING AND BATTERY INGESTION HAZARD

Keep new and used batteries and small components securely away from children and pets.

Swallowing or inserting a battery into the body can cause severe internal injury and may be life-threatening.

If a battery is swallowed or suspected of being swallowed or inserted into the body, seek emergency medical attention immediately.

Never allow children to replace batteries without responsible adult supervision.

Some products may contain lights that flash, blink, pulse, or change patterns.

6. CHILDREN & SUPERVISION

Mia’s Tree Lot grapevine trees and decorative products are NOT CHILDREN’S TOYS unless a product is expressly identified as one.

RESPONSIBLE ADULT SUPERVISION IS REQUIRED whenever children interact with products containing lights, batteries, cords, small components, decorations, or other potential hazards.

Do not permit young children to play with or operate electrical components, battery compartments, cords, or small parts.

 

7. SPECIALTY ITEMS & CRAFT-SHOW PRODUCTS

Mia’s Tree Lot may sell additional specialty products at craft shows, events, or online.

These products may include manufacturer-specific safety instructions.

Customers are responsible for reviewing and following all accompanying instructions and warnings.

Small Toys, Crayons & Stocking Stuffers

Items containing small components may present a choking hazard.

Not intended for children under three years of age when small parts are present.

Crayons and decorative craft products are NOT FOOD and should not be eaten or chewed.

Decorative Reindeer Food

Decorative reindeer food is intended for decorative/holiday use only unless expressly labeled otherwise.

NOT FOR HUMAN OR PET CONSUMPTION.

Bubble Products

Bubble solution is not edible.

Do not drink or intentionally ingest bubble solution.

Avoid contact with eyes.

If accidental eye contact occurs, rinse thoroughly with clean water.

Seek appropriate medical assistance if significant or persistent irritation occurs.

 

8. PRODUCT CARE & LONGEVITY

Natural grapevine and decorative materials may change over time.

Fading, drying, shifting of decorations, or other changes associated with age, environmental exposure, storage, and normal use are not necessarily product defects.

Improper storage, outdoor exposure, excessive moisture, excessive heat, misuse, unauthorized modification, or mishandling may damage a product.

9. PRICING

Prices may change without notice.

Applicable taxes, shipping, handling, customization, setup, delivery, or other charges may be added when applicable.

Mia’s Tree Lot reserves the right to correct inadvertent:

• Pricing errors

• Typographical errors

• Product-description errors

• Inventory errors

• Website errors

If an error materially affects an order that has already been submitted, we may contact the customer to correct the order or cancel and refund the affected purchase as appropriate.

 

10. RIGHT TO REFUSE OR CANCEL ORDERS

To the extent permitted by law, Mia’s Tree Lot reserves the right to refuse or cancel an order for legitimate business reasons, including:

• Suspected fraud

• Payment problems

• Inventory errors

• Pricing errors

• Inability to fulfill a customization request

• Abusive or threatening conduct

• Suspected unauthorized transactions

If Mia’s Tree Lot cancels a paid order before providing the applicable product, payment for the canceled item will be refunded unless otherwise permitted or required by law.

 

11. CUSTOM, BULK & SPECIAL-EVENT ORDERS

Payment is required before production begins on custom, personalized, wedding, Quinceañera, bulk, or special-event orders unless Mia’s Tree Lot agrees otherwise in writing.

ONCE PRODUCTION HAS BEGUN, CUSTOM AND PERSONALIZED ORDERS ARE FINAL SALE, except where applicable law requires otherwise.

Setup, customization, handling, delivery, and travel charges may apply.

 

📦 SHIPPING, DELIVERY & PICKUP

12. SHIPPING INFORMATION

Customers are responsible for providing a complete and accurate shipping address.

Mia’s Tree Lot is not responsible for delivery problems caused solely by an incorrect, incomplete, outdated, or undeliverable address supplied by the customer, except as otherwise required by law.

Shipping and delivery estimates are estimates and are not guaranteed arrival dates.

Carrier delays, severe weather, natural disasters, transportation interruptions, holiday volume, governmental actions, and circumstances outside our reasonable control may affect delivery.

 

13. SHIPPING DAMAGE

Inspect your order promptly after delivery.

If merchandise arrives materially damaged, contact Mia’s Tree Lot promptly and provide:

• Your order number

• Photographs of the product

• Photographs of the shipping box

• Photographs of the internal packaging

• A description of the damage

Please retain the product and original packaging while the matter or carrier claim is reviewed.

Minor shifting or loosening of decorations during shipping may be repairable and does not necessarily constitute severe product damage.

We will review the circumstances and determine an appropriate resolution, subject to applicable law.

 

14. CUSTOMER PICKUP

Customers choosing pickup are responsible for making and keeping pickup arrangements.

If Mia’s Tree Lot agrees to hold an item, the agreed hold period applies.

Items that are not picked up and customers who stop responding may be subject to cancellation or other reasonable arrangements after Mia’s Tree Lot attempts to contact the customer.

Additional charges may apply if Mia’s Tree Lot agrees to provide delivery outside our normal pickup arrangements.

 

RETURNS, REFUNDS & EXCHANGES — GRAPEVINE PRODUCTS

15. RETURN POLICY

Except where applicable law requires otherwise:

Custom and personalized merchandise is final sale once production begins.

Clearance merchandise is final sale.

Craft-show and event purchases are final sale unless otherwise stated at the time of purchase.

Cancellations and exchanges are not guaranteed.

Return shipping costs are generally the customer’s responsibility unless the return results from an error by Mia’s Tree Lot or applicable law requires otherwise.

Returned merchandise must be returned in substantially the condition in which it was received.

Damage caused after delivery may reduce or eliminate any refund that otherwise would have been available.

17. CUSTOMER PHOTOS, VIDEOS & SUBMISSIONS

Customers remain responsible for content they submit.

If you expressly authorize Mia’s Tree Lot to use photographs, videos, testimonials, or other content for promotional purposes, you represent that you have the right to provide that permission.

Such authorization permits Mia’s Tree Lot to reproduce, display, resize, crop, or publish the authorized content for the agreed promotional purpose, subject to applicable law.

 

18. REVIEWS

Reviews should represent the reviewer’s genuine experience and opinion.

Mia’s Tree Lot may moderate reviews or other submissions that contain unlawful, threatening, harassing, discriminatory, obscene, defamatory, fraudulent, spam, unrelated, or otherwise inappropriate content, subject to applicable law.

Customer reviews represent individual experiences.

These normal characteristics of handcrafted products do not necessarily indicate that a product is defective or unsafe.

30. STORAGE

These physical changes can be normal characteristics of natural ingredients and do not, by themselves, mean that a product is spoiled or defective.

Warm-weather shipping may cause tallow products to arrive softened or partially melted.

Allowing a securely closed container to return to a cooler temperature may restore a firmer consistency, although the texture may differ from its original whipped or creamy texture.

• Clear photographs of the packaging when shipping damage is involved

Retain the product and packaging until the issue has been reviewed.

Nothing in these Terms is intended to disclaim, exclude, restrict, or modify any warranty, remedy, product-liability obligation, or consumer right that cannot lawfully be disclaimed, excluded, restricted, or modified.

 

38. LIMITATION OF LIABILITY

Failure by Mia’s Tree Lot to enforce a provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision later.

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where federal or other applicable law requires otherwise.

Nothing in these Terms deprives a consumer of legal rights or protections that cannot lawfully be waived.

 

49. ENTIRE AGREEMENT

These Terms, together with applicable product information, policies, safety instructions, and any specific written agreement for a custom order, constitute the agreement concerning the applicable transaction.

If specific written terms for a custom order conflict with these general Terms, the specific written terms will control for that order to the extent permitted by law.
