Furthermore Mia’s Tree Lot accepts no reliability, durability and performance of any of our products. In no event shall our company be liable to any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of our products. Colors may, in time, fade. Do not turn upside down. Do not submerge. Do not swallow. Do not put in eyes. Keep out of the reach of children. Keep away from heat, sparks and open flame. Do not keep our products plugged in for too long, this can result in a fire, use only as directed/intended. If using our trees for outside use, just know that the weather will damage the product over time and we will not issue a refund. We respect all property rights of others. Mia's Tree Lot does use some music with our trees but we in no way own any rights to that music. Some music is also added to our videos for social media purposes. Not all trees will have sound even if you see one of our videos, please send us a request if you would like sound added to your tree.

WARNING: People who are photosensitive (have had seizures induced by flashing lights and patterns) should not use our products without first consulting a doctor. There is a possibility that photosensitivity may occur in children who have no history of prior seizures or epilepsy.

The authors/owners of this website take no responsibility for the content or information contained in any linked websites as that content is beyond our control. Mia's tree lot is not responsible for the privacy practices or the content of such Web sites.

You understand that your purchase and use is at your own risk and that we provide items on an “as is” basis “with all faults” and “as available”. You assume the entire risk as to their quality and performance. Should they provide defective, you assume the entire cost of all necessary repair or servicing.

We do not accept international Orders through our Site. Clearance items are non-returnable. The prices listed for Items available through the Site do not include shipping, handling or taxes.

We may change the Terms at any time and without notice to you. You are solely responsible for any information that you submit to us. By using the Site you agree not to submit or transmit any defamatory, abusive, obscene, threatening or illegal material, or any other material that infringes on the ability of others to enjoy the Site or that infringes on the rights of others. We reserve the right (but assume no obligation) to monitor, delete, move, or edit any submissions that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons.

Customer satisfaction is very important and we will be happy to respond to any questions or concerns you have. Refunds are considered on an individual basis. Refunds will be issued only due to severe damage while shipping (please contact us immediately) and once merchandise is returned to us. We are happy to work out a settlement with the shipper...usually UPS and will issue a refund, providing their requirements for a damage claim are fulfilled. Buyers are responsible for return shipping costs. Return shipping is your responsibility and that amount will not be refunded. If the item is not returned in its original condition, the buyer is responsible for any loss in value. Keep in mind while shipping some decorations may become loose or fall off, in that event the item is for you to repair. I don't accept exchanges or cancellations.

There is, however, NO RETURNS ON CUSTOM WORK/ ORDERS & NO RETURNS FOR ITEMS PURCHASED AT CRAFT SHOWS OR EVENTS. Please keep this in mind when you custom order items. Custom orders, Craft show / event items are sold "As is" and you assume all responsibility of that item.

Once we talk and agree on what we are making for you. We will unlock this custom order payment section and you will be able finalize your full purchase. We will not start your order until payment is received. Once payment is given cancellation is no longer possible, and the custom order cannot be refunded. We are not able to exchange or accept returns on any custom-made items.

Sometimes we do sell other items at craft shows (ex: specialty crayons, Aidan’s Lego inspired crayons) and those items are also sold as is. Remember Adult supervision/ assistance maybe required for the crayons, observe children closely and intervene as necessary to prevent potential safety problems and ensure appropriate use of arts and crafts materials. Some craft items are potential choking hazards for young children. Avoid use of small parts with children younger than 3 years. Please keep in mind allergies when using crayons such as Peanuts, Tree Nuts, Eggs & Egg Shell, Milk, Casein, Nut & Nut Oil, D&C Red Dye #40, Latex, wheat. Not gluten free. We assume no responsibility for any allergic reaction. Use at your own risk.

Prices do vary depending on the cost of supplies and at certain craft events. Prices can change at any time without notice. Taxes will be charged on all items sold.

If you see a tree you like that is out of stock please let us know and we will see what we can come up with for you. We also take custom orders and reserve the right to refuse an order if we cannot find the supplies to make what you are looking for. Once you submit an idea/recommendation to Owner, you agree that the idea becomes and remains the sole and exclusive property of Owner without further liability or compensation to you. If you respond to Owner with any information, including but not limited to feedback, data, questions, comments, suggestions, recommendations, or the like, such information shall not be deemed confidential. All such submissions shall be deemed the property of Owner, and your submission of information shall constitute an assignment to Owner of all worldwide rights, titles, and interests in such information. Owner will not be liable for any use or disclosure of such information. Owner will not have any obligation to keep such information confidential and will be free to reproduce, use, disclose and distribute the information to others without limitation. By submitting information, you warrant that Owner may publish such information/idea, use it as part of its operations, and incorporate its concepts in Owner production without liability or compensation to you.

By submitting your photo(s) or video to Mia’s tree lot, you agree that such photo(s) and/or videos and the accompanying information will become the property of MiasTreeLot.com and you grant MiasTreelot.com permission to publicly display, copy, reproduce and use the photographs and video in any form or media, whether now known or hereafter devised, for any and all editorial and related promotional purposes without making payment or other remuneration to you or any third party. You represent and warrant that (i) the photo and/or video is your original work, or is properly licensed by you, and does not violate the copyright or any other personal or property right of any third party, and (ii) you have obtained any and all releases and permissions necessary for us to publicly display, copy, reproduce and use the photo and/or video as described above. Your submission also allows Mia’s Tree Lot to edit, crop or otherwise alter any submission as it chooses.

If placing an order for a Custom item, Wedding , Quinceañera or any bulk order payment is expected before production begins. Once the product is made or is in process there is no refunds or exchanges. A special handling fee & setup charge will be added for any bulk orders. An extra charge will also be added for drop off services to reception site or meeting area. We will only travel a certain amount of miles.

If we agree to hold a tree for you to purchase we will hold that tree for five business days, if we do not hear from you after that we reserve the right to sell the tree without notice to you.

Please, please provide a valid and correct shipping address if you would like your items shipped. Once shipped, we are not responsible if we shipped to the address provided to us and it turns out to be outdated, wrong, or otherwise not valid. You are fully responsible for making sure your address and email address is correct on your order at all times.

All customer pickups have to be close/near Oswego IL, if we have to travel any further and if we agree to travel an additional charge will have be added to your order and we will notify you beforehand. If the additional charge is not paid your order will be placed on hold and we reserve the right to cancel your order completely after 5 days of no response without notice to you. It is not our responsibility to travel to you if you chose our customer pickup option. You are responsible for making arrangements with us to pickup your order near Oswego IL.
